Staff recommends the City Council:
1. Award a Professional Services Agreement (PSA) to TDG Engineering, Inc. for professional engineering design services for Fairview Road Active Transportation Improvements in the amount of $137,566, in substantially the form as attached and in such final form as approved by the City Attorney.
2. Authorize a ten percent (10%) contingency in the amount of $13,756 for any additional services that may be required by the project.
3. Authorize the City Manager and the City Clerk to execute the PSA and any future amendments to the agreement.

BACKGROUND:
The Fairview Road Active Transportation Improvements project is located on Fairview Road between Fair Drive and Newport Boulevard. Fairview Road is classified as a Major Arterial on the City’s Master Plan of Streets and Highways with proposed Class IV bicycle facilities on the City’s Active Transportation Plan.
This project will improve bicycle and pedestrian access and mobility along Fairview Road from Fair Drive to Newport Boulevard. The City has identified the need for various infrastructure improvements in the area to provide a higher quality and more inviting bicycling and walking experience.
The Fairview Road Active Transportation Improvements project will design a Class IV bicycle facility on Fairview Road by reducing the number of vehicle lanes from six lanes to four lanes from Fair Drive to Wilson Street. From Wilson Street to Newport Boulevard, the project will design bicycle facility improvements including buffered bike lanes. The pedestrian design improvements will include high-visibility crosswalks, a midblock pedestrian hybrid beacon (HAWK Signal) between Wilson Street and Fair Drive with a pedestrian refuge island, and bus boarding islands to improve pedestrian connectivity and safety. Staff has determined that existing and projected vehicle traffic volumes on Fairview Road in this segment can be accommodated on two travel lanes in each direction and the conversion of the third lane to provide Class IV bicycle facility will accommodate all users in an equitable manner.
A separate design project for the pavement rehabilitation of Fairview Road from Fair Drive to Newport Boulevard is underway. The proposed active transportation improvements will be designed in coordination with the pavement rehabilitation design project for Fairview Road. The construction bid package for Fairview Road from Fair Drive to Newport Boulevard will include both the pavement rehabilitation and the active transportation improvements. Extensive public outreach will be conducted for the Fairview Road Active Transportation Improvements project including a public outreach meeting and presentation to the Active Transportation Committee.
ANALYSIS:
On November 8, 2022, the City issued a Request for Proposals (RFP) for professional engineering design services for the Fairview Road Active Transportation Improvements. Six (6) proposals were received to provide the professional engineering design services. Proposals were reviewed for compliance with the City’s RFP, and consultants were evaluated based on project understanding, depth of experience, technical expertise, and associated evaluation criteria. After a thorough evaluation of the proposals, staff finds TDG Engineering, Inc. to be well qualified to perform the requested engineering design services for the Fairview Road Active Transportation Improvements project. The proposal submitted by TDG Engineering, Inc. represents a thorough understanding of the project, complies with City requirements, and documents TDG Engineering’s technical ability and experience with similar projects. The design fees proposed by TDG Engineering, Inc. were determined to be competitive and commensurate with the requested services.
ALTERNATIVES:
One alternative would be to not approve the PSA and conduct the project using in-house resources. However, the technical expertise and volume of the work associated with the project exceeds staff’s available resources and time. This would result in delays in the completion of the design and could jeopardize the completion of Active Transportation improvements in conjunction with the grant-funded Fairview Road pavement rehabilitation project, which is anticipated to proceed into construction later this year.
FISCAL REVIEW:
Funding for the proposed PSA with TDG Engineering, Inc. is available in the existing Capital Improvement Project funds for the Class II, III, IV Bicycle Projects approved in Fiscal Year 2022-23 budget.
LEGAL REVIEW:
The City Attorney’s Office has reviewed this report, prepared the proposed PSA and approves them both as to form.
