Staff recommends the City Council:
1. Approve proposed Amendment No. 1 to the Professional Services Agreement (PSA) with KOA Corporation increasing the maximum compensation by $30,230, for a total not-to-exceed amount of $141,017.
2. Authorize the City Manager and the City Clerk to execute the amendment and any future amendments to the agreement.

BACKGROUND:
The City received a federal Bicycle Corridor Improvement Program (BCIP) grant as well as a contribution from the Coast Community College District to design and construct pedestrian and bicycle improvements at the intersection of Adams Avenue and Pinecreek Drive. This project is in the final design phase and is anticipated to be ready for construction authorization by spring 2023. The project will improve pedestrian and bicycle mobility and access in the area.
A PSA with KOA Corporation was approved by the City Council on March 16, 2021 for engineering design services of the Adams Avenue and Pinecreek Drive Intersection Project. The scope of work for the engineering design services of the project includes the following:
• New/additional crosswalk on the west leg of the intersection crossing Adams Avenue
• Conversion of the northbound right turn slip lane to a conventional right turn lane
• Modifications to the eastbound right turn lane
• Class II bicycle lanes in the City’s right-of-way
• Sidewalk and Americans with Disabilities Act (ADA) ramp improvements
• Relocation of the bus stop on eastbound Adams
• Traffic signal modifications to accommodate these improvements
This project is being designed concurrently with the Adams Avenue Bicycle Facility Project from Harbor Boulevard to Fairview Road to provide a cohesive pedestrian and bicycle infrastructure design along the corridor. The Adams Avenue Bicycle Facility project includes Class II bicycle lanes and Class IV cycle tracks. Extensive public outreach has been conducted for both projects including two public outreach meetings, three stakeholder meetings with Orange Coast College, and a presentation to the Active Transportation Committee.
ANALYSIS:
Through the project’s design concept development process with the Active Transportation Committee as well as public outreach, a project design concept with Class I off-street multi-use paths on Adams Avenue emerged as the most desired project design alternative. The Class I multi-use paths connect to the Adams Avenue at Pinecreek Drive intersection on the northeast and southwest corners and provide a separation between active transportation users (pedestrians and bicyclists) and vehicles. The Class I multi-use paths will improve accessibility for pedestrians and bicyclists and improve multi-modal circulation. The reconfiguration of the intersection will slow right turning vehicles entering and exiting Orange Coast College and reduce conflict points.
The scope of work for the Adams Avenue at Pinecreek Drive Intersection project included Class II bicycle lanes. However, the design effort required for the option with Class I off-street multi-use paths is greater than the design effort for Class II bicycle lanes within the City’s right-of-way. This work includes additional civil engineering design sheets (grading, utility, plan and profile), design details and sections, right-of-way and utility coordination, and additional project team meetings.
Staff recommends the City Council approve the amendment to the PSA with KOA Corporation for the Adams Avenue and Pinecreek Drive Intersection Project in the amount of $30,230 for additional design services. Staff also requests City Council authorization for the City Manager and the City Clerk to execute the amendment and future authorized changes and amendments to the agreement.
ALTERNATIVES:
One alternative would be to not approve Amendment No. 1 to the PSA. However, this would result in staff’s inability to complete the additional design effort and result in delays in the completion of the design. This could jeopardize the project’s federal grant funding for both the design and construction.
FISCAL REVIEW:
Funding of the proposed amendment to the PSA with KOA Corporation is available in the existing Capital Improvement Project funds for the Adams Avenue and Pinecreek Drive Improvements Project approved in Fiscal Year 2020-21 budget.
LEGAL REVIEW:
The City Attorney’s Office has reviewed this report, prepared the proposed amendment, and approves them as to form.
