Staff recommends the City Council:

1.                     Authorize the City Manager or designee to increase the City’s table of organization to account for eleven (11) full-time custody staff to facilitate Costa Mesa Jail Operations.

 

2.                     Adopt Resolution Number 2022-XX, which amends Resolution Number 2022-35, establishing the new Custody Supervisor classification and corresponding salary range.

 

3.                     Authorize the appropriation of $175,215 from the General Fund’s (101) fund balance for Police Department custody staff to facilitate Costa Mesa Jail Operations.

BACKGROUND:

In June 2013, the City of Costa Mesa began contracting for jail services with G4S Secure Solutions (USA) Inc. (“G4S”). The contract was for a three-year term, with the option to extend the term of the contract for two additional one-year periods. The City and G4S exercised the extension options, extending the term through June 25, 2018.

In November 2017, the City released a Request for Proposal (RFP No. 18-06) for jail services in anticipation of the current G4S contract expiring on June 25, 2018. The City received one response to the RFP, which was from G4S. The proposal was for jail services at a cost not-to-exceed: Year 1 - $851,261; Year 2 - $887,491; and Year 3 - $924,098. The proposed contract with G4S contained two additional one-year extension options, the first of which was exercised in June 2021, with an expiration date of June 30, 2022 at an annual cost not-to-exceed $924,098.  In March of 2022, G4S was purchased by Allied Universal, which agreed to continue jail services under the same contract agreement.

In May 2022, Allied Universal was unable to meet Costa Mesa’s jail services needs pursuant to the contract. On May 17, 2022, City Council approved the termination of the professional services agreement for jail services between Allied Universal, assignor of G4S Secure Solutions (USA) Inc. and the City of Costa Mesa, and authorized the City Manager or designee to negotiate an agreement with the City of Huntington Beach for temporary jail services and/or to hire temporary staffing to operate the Costa Mesa Jail.

 

To mitigate the impact on police operations, seven (7) temporary part-time custody officers have been hired.  However, this is not a permanent solution in resolving the staffing requirements to safely operate the jail.

 

ANALYSIS:

The City’s Type 1 jail facility is operational 24 hours a day, 365 days a year and governed by the Board of State and Community Corrections (BSCC). Title 15 requires a sufficient number of properly trained personnel be employed in each local detention facility to ensure the safety of personnel and arrestees.

To move forward with a permanent solution, staff is recommending the City hire full-time custody staff as city employees. In order to provide the required staffing levels, one (1) newly established full-time classification of Custody Supervisor and ten (10) Custody Officer positions is recommended. This has been the Jail’s staffing level for the past nine years and has been approved by the BSCC for safe operation.  The annual contract rate for FY 22-23 with Allied Universal was proposed at $945,502. The annual cost moving forward with the additional staff would be approximately $1.12 million, which is lower than the City’s FY 2012-13 budgeted cost for jail services of $1.3 million.

ALTERNATIVES:

The City Council could decide not to authorize the hiring of full-time custody staff to facilitate the City jail; however, if the jail facility is closed, officers would be required to complete the booking process themselves and transport the arrestees directly to Orange County Jail in Santa Ana. This is not recommended because it would negatively impact police services by delaying response times in jurisdiction.

FISCAL REVIEW:

The City’s cost for jail services is budgeted annually based upon the approved and active contract for jail services. The allocation budget for jail services through Allied Universal for FY 22-23 is $945,502. Upon City Council approval, an additional appropriation of $175,215 from the General Fund’s (101) fund balance will be added to the Police Department’s FY 22-23 Operating Budget.
