RECOMMENDATION:

Staff recommends that the City Council give second reading and adopt:
Ordinance No. 2022-03, entitled: An Ordinance of the City Council of the City of Costa Mesa, California adopting an AB 481 equipment use policy of the City of Costa Mesa, California governing the use of military equipment.

BACKGROUND:

At its regular meeting on July 19, 2022, the City Council gave first reading to and introduced Ordinance No. 2022-03 by a 7-0 vote.
ANALYSIS:
The Ordinance is being presented for second reading and final adoption. If approved, the Ordinance would become effective 30 days after the second reading.
PUBLIC NOTICE:
Pursuant to Government Code 36933, a summary of the proposed Ordinance was published once on the City of Costa Mesa's website no less than 5 days prior to the August 2, 2022 second reading. A summary of the adopted ordinance will be published within 15 days after the adoption.
As of this report, no additional written public comments have been received. Any additional written comments received will be forwarded.
ALTERNATIVES:
There are no reasonable alternatives to approval of the ordinance. CMPD has not discovered alternative items that can achieve the same objectives of civilian and officer safety. Failure to adopt the ordinance and policy will preclude CMPD's use of all the identified equipment.
FISCAL REVIEW:
This item does not have a financial impact.
LEGAL REVIEW:
The City Attorney's Office prepared the ordinance and has reviewed this report and approved it as to form.
