RECOMMENDATION:

Staff recommends that the Planning Commission adopt a Resolution to:
1. Find that the project is categorically exempt from the provisions of the California Environmental Quality Act (CEQA) per CEQA Guidelines Section 15301 (Class 1), Existing Facilities; and
2. Approve Planning Application 21-24, subject to conditions of approval.

APPLICANT OR AUTHORIZED AGENT:
The applicant/authorized agent is Sean Maddocks of Retail CM1 LLC, on behalf of the property owners, Marky and Jill Stein.
BACKGROUND:
The subject property is located at 2275 Newport Boulevard at the southwestern corner of the intersection of Fairview Road and Newport Boulevard. The site is zoned C2 (General Business District) and is surrounded by other similarly zoned properties (C2) to the north and west, with Newport Boulevard and the 55 Freeway to the east and south. The site has a General Plan Land Use Designation of General Commercial and is also surrounded by similarly designated parcels to the north and west.
Existing development on the site consists of a one-story 1,738-square-foot commercial building with eighteen parking spaces on the existing surface parking lot located at the rear of the property. Access to the site is provided by two separate driveways along Fairview Road and Newport Boulevard. The existing building is currently vacant and was previously occupied by a retail flower shop (Conroy's Flowers). The proposed retail cannabis storefront use with delivery, "Nectar Markets", would occupy the entire existing building.
