Staff recommends the City Council:

 

1.                     Award a Public Works Agreement (PWA) to California Waters Development, Inc., 23311 E. La Palma Avenue, Yorba Linda, California 92887, in the amount of $281,340 (Attachment 1).

 

2.                     Authorize the City Manager and City Clerk to execute the PWA and future amendments to the agreement within Council authorized limits.

 

3.                     Authorize an additional ten percent (10%) contingency totaling $28,134 as needed for unforeseen costs.

 

4.                     Approve a budget reallocation in the amount of $34,474 from the Building Modifications Project to the Downtown Aquatic Center Pool Re-plastering Project.

BACKGROUND:

The Downtown Aquatic Center is located at 1860 Anaheim Avenue, which is a part of the Downtown Recreation Center complex. The Aquatic Center pool provides recreational activities ranging from swimming to various aquatic events, including water polo. Residents and students from local area schools have utilized and enjoyed the pool’s services throughout the year, especially during the summer season. Over the years, the Aquatic Center pool has endured frequent use and gradual wear, and as a result, it is in need of re-plastering repair within the walls of the inner pool.

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

 

Downtown Aquatic Center

ANALYSIS:

The scope of work for this project involves all tasks to fully repair the inner surface of the Aquatic Center pool through re-plastering. In order to achieve this repair, the existing pool will be drained and the contractor will remove all existing tile and plaster, clear the damaged and rusted sections of concrete and steel reinforcement, patch all affected areas, replace the plaster and tile, implement upgrades to the handrails, and improve existing signage. The contractor is expected to complete all of the tasks necessary to perform the work as outlined in the contract documents.

 

The City Clerk received and opened one (1) bid for this project on September 13, 2021. However, staff received one (1) bid from a contractor who did not possess the requisite license to perform this work.

 

The project was re-bid and the City Clerk received two (2) bids on November 1, 2021. California Waters Development, Inc., the apparent low bidder, submitted a bid proposal in the amount of $281,340, and the average of the two bids received is $308,914. The bid results are summarized in the bid abstract (Attachment 2).

 

A copy of specifications and working details are available for review in the Office of the City Clerk or in the Public Services Department, and are posted on the City website at:

California Waters Development, Inc., possesses the required license to perform the work and has completed similar work in other areas. Therefore, staff requests that City Council award the PWA to California Waters Development, Inc.

 

ALTERNATIVES:

The alternative to the Council action would be to reject all bids, re-advertise, and re-bid the project. Staff does not conclude that re-advertising and re-bidding the project will result in lower cost bids.

FISCAL REVIEW:

Funding for this project is included in the FY 2021-22 Approved Capital Improvement Project (CIP) Budget; an additional reallocation of $34,474 from the Building Modifications Project to the above-mentioned project in the Capital Improvements Fund (401) is requested.

LEGAL REVIEW:

The City Attorney’s Office has reviewed this report and prepared the Public Works Agreement and approves them both as to form.

 

CITY COUNCIL GOALS AND PRIORITIES:

In 2021, the City Council adopted a list of three-year goals. The project works toward achieving the following City Council goal:

 

                     Strengthen the public’s safety and improve the quality of life.
