Staff recommends the City Council:
1. Award a Professional Services Agreement (PSA) to Pacific Advanced Civil Engineering (PACE), 17520 Newhope Street, Suite 200, Fountain Valley, California 92708 for two years with two one-year renewal periods, in an amount not to exceed $120,425 for engineering design services for the TeWinkle Park Lakes Upgrades Project (Attachment 1).
2. Authorize an additional ten percent (10%) contingency in the amount of $12,050 as needed for any unforeseen costs related to this project.
3. Approve a budget reallocation in the amount of $7,475, from the Tanager Park Playground Exercise Equipment Replacement Project to the TeWinkle Park Lakes Upgrades Project.
4. Authorize the City Manager and City Clerk to execute the PSA and future amendments to the agreement within Council authorized limits.

BACKGROUND:
TeWinkle Park is a 49-acre park dedicated in 1965 in honor of the first mayor of the City of Costa Mesa, Charles TeWinkle. The TeWinkle Park Lakes are artificial water features consisting of two (2) lakes, two (2) ponds, an intermediate pond, five (5) streams, nearly two (2) acres of water surface, and approximately 3,250 feet of shoreline. A partial renovation of the lakes was undertaken in 2004. Over the past several years, water leakage has developed in the two primary lakes, resulting in significant water loss as well as undermining of the lakebed and surrounding soil areas.
TeWinkle Park Lakes
The intermediate pond, along with the dual streams were not constructed during the prior renovation and lack waterproofing. In addition, staff has observed excess water percolation and infiltration losses into the soil below and around the lakes. Pumps and the gravel bed biological filter have not been functioning and are in need of repair. The water quality of the lakes has been compromised due to excess nutrient input, and the aeration and ozone systems are not currently operational.
The TeWinkle Park Lakes Upgrades Project will address these deficiencies and produce a comprehensive set of plans, specifications, and estimates for the proposed improvements. In addition to improving the functionality and operational efficiency of the lake system, the project also seeks to enhance the safety, aesthetic and recreational value of the lakes at TeWinkle Park.
ANALYSIS:
On May 14, 2021, a Request for Proposals (RFP) was issued for engineering design services for this project. Staff received three (3) proposals from the following consulting design firms:
• Pacific Advanced Civil Engineering (PACE)
• Michael Baker International
• Aquatic Studio
After review of the proposals, staff determined that Pacific Advanced Civil Engineering (PACE) was the most qualified consultant based on extensive experience in performing engineering design services on similar lake rehabilitation and water resource management projects.
PACE has performed technical evaluations of water resource systems and completed engineering design services for projects throughout Southern California, as well as supported several public agencies in developing innovative strategies to address water quality and lake management issues. PACE maintains a staff of water engineering specialists and lake management professionals with expertise about artificial systems such as the lakes at TeWinkle Park. Moreover, the firm has a history of delivering projects that incorporate sustainable, value-oriented solutions that provide lasting benefit and cost-savings to its clients, which is one of the City’s priorities for this project.
The consultant will be responsible for performing the engineering design evaluation of the lake systems, and producing a set of working plans, specifications and estimates that will be implemented during the construction phase. PACE will also assist in coordinating community meetings and preparing applicable presentation materials to be used for the public outreach component of this project. The consultant’s scope of work is further defined in the proposal, which is incorporated by reference within the Professional Services Agreement.
ALTERNATIVES:
The alternative to this City Council action would be to reject all of the proposals and to re-advertise the RFP. Staff does not anticipate that this would result in selecting a more qualified firm or lower fees.
FISCAL REVIEW:
Funding for the TeWinkle Park Lakes Upgrades Project is included in the FY 2021-22 Park Development Fees Fund Budget. A budget reallocation in the amount of $7,475 is requested to authorize the use of surplus Park Development Fees from the Tanager Park Playground Exercise Equipment Replacement Project budget to the TeWinkle Park Lakes Upgrades Project to fully fund the contingency.
LEGAL REVIEW:
The City Attorney’s Office has reviewed this report and prepared the Professional Services Agreement and approves them as to form.
CITY COUNCIL GOALS AND PRIORITIES:
In 2021, the City Council adopted a list of three-year goals. The project works toward achieving the following City Council goal:
• Strengthen the public’s safety and improve the quality of life.
