RECOMMENDATION:

Staff recommends the City Council give second reading to and adopt Ordinance No. 2021-16 (Attachment 1), amending Chapter IV (Garbage, Rubbish and Weeds) of Title 8 (Health and Sanitation) of the Costa Mesa Municipal Code to implement the requirements of SB 1383 (mandatory organic waste disposal reduction).

BACKGROUND:
At its regular meeting of October 5, 2021, the City Council introduced for first reading, Ordinance No. 2021-16 and approved it by a 7-0 vote. The City Council made no changes to the proposed Ordinance. The agenda report and video of the October 5, 2021 City Council meeting can be found at the following link:

ANALYSIS:
The City is required by SB1383 regulations to adopt an ordinance by January 1, 2022 to mandate that all organic waste generators, haulers and other entities that operate in the City meet the SB1383 requirements. Staff recommends the adoption of the proposed ordinance to ensure compliance. If approved, the Ordinance would become effective 30 days after the second reading.
ALTERNATIVES:
There are no alternatives to adopting the ordinance in substantially the form proposed. However, the City Council could direct staff to consider certain modifications to the proposed Ordinance and bring it back for proposed adoption at the next City Council meeting.
