RECOMMENDATION:

Staff recommends the City Council:

1. Approve Amendment No. 7 to Agreement No. C-5-3612 between Orange County Transportation Authority (OCTA) and the City of Costa Mesa for the I-405 Improvements Project and authorize the Mayor and the City Clerk to execute the agreement.

2. Appropriate $1,989,000 in compensation towards Pavement Mitigation I-405 Project.

BACKGROUND:
OCTA and the City of Costa Mesa entered into Cooperative Agreement No. C-5-3612 in April 2016 for the I-405 Improvements project. The agreement identified roles and responsibilities of each agency for the implementation of the project. The City of Costa Mesa provided staff and consultant support to review project plans and assistance during the construction phase. OCTA's role was for the implementation of the project meeting City and State requirements as well as reimbursement to the City for all services and costs incurred during the project, and for pavement restoration work caused by project detours. Over the past few years, several amendments have been made to the original agreement to authorize minor increases in allowances for project reviews as well as time extensions.

ANALYSIS:
The I-405 Improvements Project was substantially completed and formally opened to the public on December 1, 2023. OCTA and the City have been engaged on reviewing various punch list items as well as formalizing maintenance agreements with the State of California Department of Transportation (Caltrans) for areas within Costa Mesa's portion of the project. City staff also reviewed pavement damages caused by I-405 project detours. ...
