RECOMMENDATION:

Staff recommends the City Council:

1.                     Find the project categorically exempt from CEQA and adopt plans, specifications, and working details for the Connector Pipe Screen Installation Project, Phase IV, City Project No. 23-08.

 

2.                     Authorize the City Manager and City Clerk to execute a Public Works Agreement (PWA) in the amount of $283,500, and future contract amendments within City Council authorized limits to United Storm Water, Inc., 1400 E. Valley Boulevard, Industry, California 91746.

 

3.                     Authorize a ten percent (10%) contingency in the amount of $28,350 for unforeseen construction and miscellaneous costs related to the project.

 

4.                     Authorize a budget appropriation from available fund balances from drainage fund in the amount of $55,967.

 

ENVIRONMENTAL DETERMINATION:

 

The proposed action is exempt from the California Environmental Quality Act (CEQA). The action involves an organizational or administrative activity of government that will not result in direct or indirect physical change in the environment. In addition, the proposed action is exempt under Section 15301 relating to the operation, repair, maintenance, permitting, and/or minor alteration of existing public facilities.

BACKGROUND:

On July 19, 2022, the City of Costa Mesa adopted a resolution for the Application of Grant Funds for the Environmental Cleanup Program (ECP), Tier 1 grant program for the 2022 Connector Pipe Screen Installation Project, Phase IV.

 

The Tier 1 Environmental Cleanup Program grant is administered by the Orange County Transportation Authority (OCTA) and allocates grant funding specifically towards street-scale catch basin and drainage system retrofit projects that target transportation-generated pollutants from stormwater discharges and in particular trash and debris generated along roadways. 

 

In 2022, as part of OCTA’s programming recommendations, the City of Costa Mesa was awarded $160,000 in funding for the Connector Pipe Screen Installation Project, Phase IV.

 

ANALYSIS:

The City Clerk received and opened 2 bids for this project on November 13, 2023.  United Storm Water Inc., the apparent low-bidder, submitted a bid proposal in the amount of $283,500.  The bid abstract reflecting the bid results is included as Attachment 1.

 

The scope of work for the project will consist of providing labor and materials to install 300 full-capture certified connector pipe screens at City-owned catch basins at various locations throughout the City of Costa Mesa.  The project is part of the City’s various water quality compliance efforts to comply with state requirements and implement the City’s National Pollutant Discharge Elimination System (NPDES) requirements.

 

Upon City Council award of the Public Works Agreement (PWA), United Storm Water will furnish the necessary bonds and insurance, which will be approved as to form by Risk Management.  The PWA will be drafted by the City Attorney’s office after City Council award and executed afterward. After the award and subsequent execution of the agreement, a “Notice to Proceed” will be issued.

 

The license and references of United Storm Water, Inc. were checked and found to be in good standing. United Storm Water Inc. has successfully completed other City projects, including the 2017, 2018, and 2019 Connector Pipe Screen Installation Projects.

 

ALTERNATIVES:

The alternative to this Council action would be to reject all bids and rebid the project. Staff has determined that re-advertising and re-bidding the project will not result in lower bids and will delay the project.  In addition, the City may lose OCTA grant funding if the Council acts not to award this project.

 

FISCAL REVIEW:

The FY 2023/24 amended budget includes $95,885 in the Drainage Fund and $160,000 in Measure M2 Funds for a total budget of $255,883 for the Catch Basin Inserts project - Various Locations. An additional appropriation of $55,967 from available fund balances from the drainage fund is required to fully fund the project and contingency.

 

LEGAL REVIEW:

The City Attorney’s Office has reviewed this agenda report and approves it as to form.
