Staff recommends the City Council:
1. Award a Professional Services Agreement (PSA) for the collection and disposal of abandoned bulky items in the City’s rights-of-way to Ware Disposal Company, Inc., in an annual amount of $104,832 for an initial term of two (2) years, with an additional three (3) one-year renewal options.
2. Authorize the City Manager to execute the PSA and any future amendments to the agreement.

BACKGROUND:
High volumes of bulky items are illegally discarded and abandoned daily within and adjacent to the City’s rights-of-way, contributing to health and safety concerns. In 2025, the monthly average of 12.41 tons of material, including but not limited to mattresses, appliances, electronic waste, and furniture, was abandoned in the public right-of-way. These conditions create significant liability for the City and have a negative impact on the surrounding neighborhood properties.
Since 2021, the City has contracted the services of Ware Disposal, a private waste hauler, to assist with the pickup and disposal of illegally discarded items, particularly in areas with a high concentration of multi-family properties. This current agreement with Ware Disposal will expire on June 30, 2026.
ANALYSIS:
On February 11, 2026, the City released a Request for Proposal (RFP) on PlanetBids for bulky item collection services in City Council districts 2, 4, and 5, which have historically been the areas most impacted by illegal dumping. The proposed PSA also includes an option to expand services to other areas.
Three (3) proposals were received to provide these services, and a summary of the bid results is included as Attachment 1. Proposals were screened for compliance with the City’s RFP and evaluated based on the method of approach, qualifications, experience, staffing, and cost proposal. The evaluation committee, consisting of three members, evaluated the proposals individually and determined Ware Disposal, Inc. as the highest rated bidder.
As the current service provider, Ware Disposal, Inc. possesses a strong understanding of the City’s service needs and owns and operates its own transfer and processing facility, Madison Materials in Santa Ana.
Therefore, staff recommends award of a PSA (Attachment 2) to Ware Disposal, Inc. for an initial two (2) year term with three (3) optional one-year renewal periods in a not to exceed amount of $104,832 annually. The initial term of this agreement will begin July 1, 2026, and end June 30, 2028.
ALTERNATIVES:
The City may consider re-issuing the RFP for Bulky Item Collection Services. However, this process is unlikely to obtain cost below that of Ware Disposal, Inc. Staff does not recommend this option.
FISCAL REVIEW:
Funding for the agreement is included in the proposed Fiscal Year 2026-27 Operating Budget in the General Fund (Fund 101), contingent upon City Council’s approval and adoption of the next fiscal year budget.
LEGAL REVIEW:
The City Attorney’s Office has reviewed this agenda report, prepared the PSA, and approves them both as to form.
