Staff recommends the City Council:
1. Approve the proposed Cooperative Agreement between the County of Orange and the City of Costa Mesa for funding and maintenance of the Adams Avenue Bridge over the Santa Ana River and Greenville Banning Channel.

2. Authorize the Interim City Manager and the City Clerk to execute the Cooperative Agreement and future amendments thereto.

BACKGROUND:
The County of Orange, through Orange County Public Works (OCPW), has embarked on a maintenance program for its bridge structures throughout the county and has scheduled bridge maintenance repairs on the Adams Avenue Bridge over the Santa Ana River and Greenville Banning Channel (Attachment 1).

OCPW has been taking the lead for the maintenance activities for this bridge and has approved the repair of the bridge. The planned scope of work for the project includes replacing the bridge joint seals and repairing the damaged handrails on the bridge. The west portion of the bridge is within the County's jurisdiction, whereas a portion of the bridge on the east side roadway approach, to 40-feet east of the bridge, is within the City of Costa Mesa's public right-of-way limits.

ANALYSIS:
OCPW has maintained the bridges within its jurisdiction and jointly cooperated with the City of Costa Mesa in its efforts to upgrade its facilities. The proposed work will utilize County funds; no City funds will be used for these bridge maintenance projects.



The Cooperative Agreement for bridge maintenance (Attachment 2) is necessary for the County to fund this project that partially lies within the City's right-of-way. In order for the County to expend funds outside of its jurisdiction, the portion of the bridge structure that's within the City of Costa Mesa's public right of way limits would need to be declared as a County highway to be repaired with County funds. To accomplish this, and in accordance with Streets & Highways Code, Sections 1700-1703, the County would adopt a resolution declaring the City's roadway within the project area to be a County highway for the purposes of construction and maintenance only. Upon receipt of the County's resolution, the City would then consent, also by resolution, to the proposed County highway status.

This Cooperative Agreement will become effective upon the approval of the City Council and the County Board of Supervisors.

ALTERNATIVES:
The alternative to the Council action would be to reject the County's proposed Cooperative Agreement. Staff does not recommend this action as this will lead to the further degradation of the bridge and the City may be obligated to use its own funds for the maintenance and repair.
FISCAL REVIEW:
There is no fiscal impact to the City of Costa Mesa. City funds will not be used for this project. The County of Orange will be responsible for all maintenance and repair expenses.
LEGAL REVIEW:
The City Attorney's Office has reviewed this report and the proposed Cooperative Agreement and approves them both as to form.
CITY COUNCIL GOALS AND PRIORITIES:
This project works toward achieving the following City Council goals:

* Maintain and Enhance the City's Facilities, Equipment and Technology
* Strengthen the Public's Safety and Improve the Quality of Life

CONCLUSION:
Staff recommends the City Council:
1. Approve the proposed Cooperative Agreement between the County of Orange and the City of Costa Mesa for funding and maintenance of the Adams Avenue Bridge over the Santa Ana River and Greenville Banning Channel.

2. Authorize the Interim City Manager and the City Clerk to execute the Cooperative Agreement and future amendments thereto.
