Staff recommends the City Council:
1. Approve an amendment to the Professional Services Agreement (PSA) to increase the compensation amount by $64,132.15 for a new not-to-exceed (NTE) compensation amount of $305,506.15 with Z&K Consultants, Inc., 17130 Van Buren Blvd. #122, Riverside, CA 92504, for construction management and inspection support services for the Adams Avenue Bicycle Facility Project.
2. Authorize the City Attorney to prepare the Amendment and the City Manager and the City Clerk to execute the Amendment and any future amendments to the agreements within Council authorized limits.

BACKGROUND:
The Adams Avenue Bicycle Facility Project (From Harbor Boulevard to Fairview Road), Federal Project No. STPL-5312(108), City Project No. 25-11 (Project), is an ongoing federally funded project that seeks to improve traveler accessibility and safety.
The Project narrows the raised center medians to provide enhanced bicycle facilities without reducing the number of vehicular lanes along Adams Avenue. From Harbor Boulevard to Pinecreek Drive, the project is constructing new protected Cycle Track bikeways on both sides of Adams Avenue. From Pinecreek Drive to Fairview Road, the project will provide a new Cycle Track along eastbound Adams Avenue, and a new Class II Buffered Bike Lane along westbound Adams Avenue adjacent to existing on-street parking. The Project includes slurry seal, new landscaping and irrigation, new streetlighting, green bicycle markings, and traffic signal and bikeway modifications at the intersection of Adams Avenue and Fairview Road.
The new bicycle facilities will connect to the City’s award-winning multi-use bicycle and pedestrian pathways constructed at the intersection of Adams Avenue and Pinecreek Drive that finished construction in May 2025. These upcoming improvements will create a continuous low-stress bikeway from Harbor Boulevard to Fairview Road and will improve mobility and connectivity to Orange Coast College (OCC) and the surrounding neighborhoods. The barrier separated bikeways provide a safer space for bicyclists, and also further separate motorist traffic from pedestrians walking along the sidewalks.
On December 2, 2025, the City Council awarded a Public Works Agreement to Excel Paving Company for construction of the improvements in the amount of $2,268,636, as well as a Public Services Agreement to Z&K Consultants, Inc. (Z&K) for construction management and inspection services, in the amount of $241,374. The Project began construction in February 2026 with a construction duration of ninety (90) working days.
ANALYSIS:
The construction of the improvements on Adams Avenue from Harbor Boulevard to Fairview Road began on February 9, 2026. The Project is well underway and is anticipated to be completed by September 2026.
During construction, there was a need for additional construction management and inspection support services beyond the original scope of the project as well as additional working days approved beyond the ninety (90) working days due to the following reasons:
• During excavation, the current below ground soil was identified to be a poor mix that retains excess water and is unsuitable as a structural base for the new asphalt serving motor vehicles. After unsuccessful attempts to treat the soil, the soil was required to be removed, and additional excavation work and compaction testing were required.
• The existing soil in the landscaped medians was also found to be unsuitable for sustaining health and vibrancy for newly planted trees and shrubs. The existing soil contained high concentrations of heavy metals and had poor characteristics (drainage, acidity, etc.). To ensure successful growth of the new landscaping, the Project required additional soil removal and replacement with high-quality topsoil.
• During the Project, City Staff identified an opportunity to upgrade the Cycle Track vertical separation from plastic bollards to extruded concrete curbs within the existing construction budget and federal grant. The installation utilized the time-saving machine that was initially utilized for the construction of the center medians. The extruded concrete curbs provide a lower-stress bicycle facility with more continuous and hardened separation between motorists and bicyclists. The curbs also further separate motor vehicle traffic from pedestrians walking along the sidewalk. The extruded curb separation between motorists and cyclists aligns with industry best-practices for bikeway design and provides a demonstration of concept within the City of Costa Mesa following similar treatments in Irvine, Yorba Linda, Westminster, San Clemente, Long Beach, and Santa Ana.
• To effectively manage traffic during the construction along Adams Avenue, the project was separated into multiple phases of work which resulted in more complicated traffic control and an increase of materials testing services required for the project.
The above issues and additional work will require the construction duration to be extended by an additional twenty (20) working days for a total duration of one-hundred and ten (110) working days.
Due to the above delays caused by unforeseen issues that have arisen during construction, as well as scheduling of project enhancements, the contract with Z&K will need to be increased by $64,132.15 to continue the construction management and inspection services. The additional budget will secure construction management support to deliver project through completion while satisfying the federal grant-required monitoring and tracking. As the increase in the contract with Z&K exceeds 10 percent, City Council approval of the amendment is requested. Funding for this increase is available in the project budget.
There will be no amendment to the construction contract for Excel Paving to complete their construction activities.
ALTERNATIVES:
The City Council could choose not to approve the amendment to the PSA and direct City Staff to conduct the construction management and inspection services in-house. Federally funded projects require inspectors to visit the project site daily and track hours of construction staff, create daily logs of activity and resources utilized, conduct labor compliance investigations, as well as attest to hours of the construction staff. However, this alternative to utilize City staff for remaining construction management and inspection services is not recommended due to the complexity of managing federally funded projects and the limited available City staff resources and time.
FISCAL REVIEW:
Funding for the PSA amendment is available in the project budget, consisting of Traffic Impact Fee (TIF) (Fund 214) with an available budget of approximately $500,000 and Regional Measure “M2” Fairshare (Fund 416) with an available budget of approximately $100,000.
LEGAL REVIEW:
The City Attorney’s Office has reviewed this agenda report and approves it as to form. The Amendment to the PSA will be drafted following City Council approval and executed thereafter.
