Staff recommends the City Council:
1. Adopt plans, specifications, and working details for the Traffic Signal and HAWK Signal Installation Project, City Project No. 22-07.
2. Authorize an expense appropriation in the amount of $192,037 from the Traffic Impact Fee fund balance for the project.
3. Award a construction contract to Elecnor Belco Electric, Inc., 14320 Albers Way, Chino, CA 91710, in the amount of $784,877 (Attachment 1).
4. Authorize the City Manager and City Clerk to execute the Public Works Agreement (PWA), and authorize the City Manager to execute future contract amendments within Council authorized limits.
5. Authorize an additional ten percent (10%) contingency totaling $78,488 as needed for unforeseen costs.
6. Find this item categorically exempt from the California Environmental Quality Act (CEQA) pursuant to Class 3: New Construction, Class 4: Minor Alterations to Land and Cal. Code of Regs. Section 15064.3(b)(2) Transportation Projects.

BACKGROUND:
The scope of the Traffic Signal and HAWK Signal Installation Project, City Project No. 22-07, includes the construction and installation of a traffic signal at the intersection of West 19th Street and Wallace Avenue, and two (2) High-Intensity Activated CrossWalK (HAWK) signals at West 18th Street next to Lions Park and at West Wilson Street next to Wilson Park.
West 19th Street is classified as a primary arterial highway, according to the Orange County Transportation Authority’s (OCTA) Master Plan of Arterial Highways (MPAH). The installation of the new traffic signal at West 19th Street and Wallace Avenue will help alleviate congestion, improve mobility, promote safe pedestrian traffic crossing, and facilitate the efficient flow of travel along West 19th Street.
Moreover, new concrete curb bulb-outs will be installed at the intersection of West 19th Street and Wallace Avenue in order to enhance visibility, shorten crossing distances, and encourage motorists to drive at slower speeds.
The HAWK signal installations at Lions Park and Wilson Park will provide protected pedestrian crossings, stopping vehicular traffic as necessary. This will improve walk and bike access to adjacent parks.
The contractor is required to complete all of the tasks necessary to perform the scope of work as outlined in the contract documents, plans, and specifications. A copy of the specifications and working details is available for review in the Office of the City Clerk or in the Public Works Department, and is posted on the City website at:

ANALYSIS:
The City Clerk received and opened nine (9) bids for this project on November 9, 2022. Elecnor Belco Electric, Inc. (Belco), the apparent lowest bidder, submitted a bid proposal in the amount of $784,877. The Engineer’s estimate for this project is $620,000, which is approximately 26% below the low bid submitted by Belco. The difference between the Engineer’s estimate and Belco’s bid proposal is attributed to concrete construction work for the intersection bulb-outs at West 19th Street and Wallace Avenue, which is a specialty item that will be done by a sub-contractor. In addition, the overall rise in construction costs related to both labor and materials also contributed to the difference between the Engineer’s estimate and Belco’s bid proposal. The average of the seven (7) bids received amounted to $885,275. The bid results are included as Attachment 2.
The license and references of Belco have been checked and staff has found them to be in good standing. Belco has successfully completed similar projects in Costa Mesa, which includes the traffic signal installation at Fairview Road and Village Way.
Upon City Council award of the Public Works Agreement, Belco will furnish the necessary bonds and insurance, which will be approved as to form by Risk Management. After the award and subsequent execution of the contract, a “Notice to Proceed” will be issued.
Therefore, staff recommends that City Council award the contract to Belco as the lowest responsible bidder.
Staff also requests City Council approval for transfer of $192,037 from the unappropriated Traffic Impact Fee fund balance in order to adequately fund the project and the contingency.
ALTERNATIVES:
The alternative to this Council action would be to reject all bids, re-advertise, and re-bid this construction project. Staff has determined that re-advertising and re-bidding this project will not result in lower bids and will delay the project.
FISCAL REVIEW:
The current available funding for this project in the amount of $671,328 has been appropriated from prior Capital Improvement Project (CIP) budgets approved by City Council using Capital Improvement Fund (401), Measure “M2” Fairshare Fund (416), and Traffic Impact Fees Fund (214). Upon approval by City Council, an expense appropriation will be established in the amount of $192,037 from the Traffic Impact Fees (214) fund balance for the remainder of the project and the contingency amount. As of June 30, 2022, the Traffic Impact Fees Fund has a fund balance of $5.6 million.

The City Attorney’s Office has reviewed this agenda report, prepared the PWA, and approves them both as to form.
